9月27日,工商總局公布《網絡購買商品七日無理由退貨實施辦法》并向社會公開征求意見。《征求意見稿》明確,網絡商品銷售者應當履行七日無理由退貨義務。經營者采用電視、電話、郵購等方式銷售商品,參照本辦法執行。辦法自2017年3月15日起施行。

China's administration of Industry and Commerce issued a draft refund policy for online shopping on Wednesday. The policy was issued to solicit public opinion.
工商總局周三(9月27日)發布網購退貨辦法草案,向社會公開征求意見。
The draft lays out that customers can refund products purchased online within seven days. The customer can return products without giving reason and they must be responsible for the return shipping fee.
草案規定,消費者網購商品七天之內可以無理由退貨,但是要承擔退貨運費。
此次七天無理由退貨辦法涉及的不僅是網絡購物(online shopping),經營者采用電視、電話、郵購等方式銷售商品(TV shopping, telephone shopping and postal shopping),也參照本辦法執行。
雖然辦法規定消費者可以無理由退貨,但是有七種情形的商品不適用七日無理由退貨規定:
消費者定做的商品(custom-made products);
鮮活易腐的商品(fresh or perishable goods);
在線下載或者消費者拆封的音像制品、計算機軟件等數字化商品(audiovisual products downloaded or unfolded, digital products like computer software);
交付的報紙、期刊(newspapers and periodicals);
消費者在購買時確認:
拆封后易導致商品性質改變、影響人身安全或者生命健康的商品(products that change or undermine people's health once unpacked);
一經激活或者試用后價值貶損較大的商品(products largely devalued after activated or used);
銷售時已明示的臨近保質期的商品、有瑕疵的商品(products that the customer is aware will soon expire or are flawed)。
此外,《征求意見稿》還規定消費者退回的商品應當完好(returned products is supposed to remain in good condition)。消費者退貨時應當將商品本身、配件及贈品一并退回(any gifts or accessories from the merchant must be returned together with the purchased products)。如果贈品不能一并退回,經營者可以要求消費者按市場價支付贈品價款。
